General Terms of Sale and Use
I – The parties
1st The Company Jabadao SAS, a simplified stock company, with a 10.000€ capital, whose registered office is located at Rua Fernandes Tomas, 25-1 1200-177 Lisbon Portugal, registered with the Câmara de Lisboa under n. 514392762 and registered under the intra-community VAT number PT514392762 is represented by Emmanuelle Wallaert who operates the www.maisonjeanne.com website
hereinafter referred to as "Website", on the one hand, and
2nd The non-commercial individual who visits selects and orders Products and services available on the Website for exclusively personal purposes.
hereinafter referred to as "Customer", on the other hand,
have agreed on the conditions of these general terms of sale and use.
II - Applications of the GTSU
Clause 1 – Framework
The general terms of sale and use (hereinafter referred to as "GTSU") apply to all orders for products and services made through the website to Jabadao by the Customer.
The customer, prior to any order, must read the GTSU. By ticking the words "I have read and I accept the general conditions of sale and use", the customer accepts the full and unreserved commitment to these Terms and Conditions.
Jabadao reserves the right to adapt or modify these Terms and Conditions at any time. The version of the applicable GTSU to any sale is that appearing online on the site www.maisonjeanne.com at the time of the order.
Clause 2 – Site information and accessibility
www.maisonjeanne.com is an e-commerce site owned and operated by Jabadao and hosted by SAS OVH whose head office is located at 2 rue Kellerman BP 80157 59100 Roubaix France.
Jabadao does not guarantee that the website will be free from anomalies, errors or bugs, or that the Website will operate without failure or interruption. In this regard, it may freely determine, at its sole discretion, any period of unavailability of the Website or its content. Jabadao cannot be held responsible for problems related to data transmission, connection or unavailability of the network.
Jabadao reserves the right to change the website, for technical or commercial reasons. When these modifications do not alter the conditions of the supply of the services, in a substantial or negative way, the customer can be informed of the modifications made, yet his/her acceptance is not required.
Jabadao guarantees that any contact made by the customer through the emails specified on the website: hello@maisonjeanne.com and emma@maisonjeanne.com, whatever the reason, will receive an acknowledgement of receipt and/or an answer within a maximum of 48 hours.
III – Order
Clause 1 - Registration on the Website
The Customer can place an order from the Shop or the Lookbook. To do this, the customer must first register on the website by creating a Customer account including the necessary contact information.
The registration of the Customer on the website is validated by Jabadao after verification of the mandatory form completed by the Customer. The Customer receives a registration confirmation email.
When creating an Account, the Customer must ensure the accuracy and completeness of the data he/she provides. The Customer is required to always update his/her personal information. In the event of an error in the address details of the recipient, Jabadao cannot be held responsible for the impossibility of delivering Products.
By registering on the Website, the Customer declares and guarantees to Jabadao that he/she is of age and has the legal capacity to contract.
Jabadao may delete the Customer's Account at any time, for any reason, at its sole discretion.
Clause 2 – Products
The Products offered for sale are those described on the Website on the day the Customer consulted the Website, within the limits of available stocks.
These indications are automatically updated in real-time. However, an error in the update, whatever its origin, does not engage the responsibility of Jabadao.
As such, Jabadao cannot be held responsible for the cancellation of an Order of a Product due to stock depletion.
Jabadao takes the greatest care in the presentation and description of these products to best inform the Customer. However, it is possible that errors may appear on the website, which the Customer acknowledges and accepts.
Clause 3 – Order
Ordering on the Website is subject to compliance with the procedure set up by Jabadao on the site including successive steps leading to the validation of the Order.
The Customer can select as many Products as he/she desires to add to the shopping cart (the "Cart").
The Cart summarizes the Products chosen by the Customer as well as the prices and related delivery costs. The Customer may freely modify the Cart before validating his/her Order.
The validation of the Order is confirmation of the acceptance by the Customer of the GTSU, the Products purchased, their price and associated delivery costs.
A confirmation email summarizing the Order: Products, price, quantity, date of the order, delivery costs if applicable and the method of payment chosen by the customer, will be sent to the Customer by Jabadao.
For this purpose, the Customer formally accepts the use of email for the confirmation by Jabadao of the content of the Order.
The invoices are available in the section "My account - order details and history" of the site.
Clause 4 - Inability to process an order
Jabadao reserves the right to withdraw any Product posted on the Website at any time and to replace or modify any content or information contained on the Website.
Despite Jabadao's best efforts to meet the expectations of its customers, it can happen that it is unable to process an order after having sent the Customer the confirmation email summarizing the Order.
Jabadao cannot be held responsible towards the Customer or a third party because of the decision to withdraw a Product from the Website, or because of the decision to replace or modify any content or information contained on this Website, or the refusal to process an Order after sending the confirmation email summarizing the Order.
Clause 5 - Cancellation of an order
The Customer has a withdrawal period of 24 hours from the exact time of validation of his/her order as stipulated on the order confirmation sent by email by Jabadao. In this case, the customer must send an email to hello@maisonjeanne.com to validate this right of withdrawal.
Jabadao then cancels the order. Upon receipt of payment from the customer by one of our suppliers, be it Paypal or Redunicre, Jabadao undertakes to reimburse the customer for the total amount of the purchases including the delivery costs within a period of 15 (fifteen) working days.
IV - Prices and Methods of payment
Clause 1 – Price
The prices of the Products are indicated on the Website in euros, including VAT, but exclude customs fees and other possible taxes.
All prices displayed are calculated with the value-added tax (VAT) applicable to Portugal included (23%), which may be different depending on the billing country.
Jabadao reserves the right to change its prices at any time through the Products will be charged based on the current price list at the time of registration and payment of the order, subject to availability.
Clause 2 - Terms of payment
The Products are payable from the time of the actual Order.
The payment of purchases is made either via Paypal or via the secure platform of our partner Unicre.
The Customer expressly acknowledges that the communication of his/her credit card number to Jabadao is equivalent to the debit authorization of his/her Account up to the price of the Products ordered. If necessary, a notice of cancellation of an Order for non-payment is sent to the Customer by Jabadao to the email address provided by the Customer when registering on the Site.
V – Delivery
Clause 1 - Terms of delivery
For all European countries to which shipping is available (Germany, England, Belgium, Spain, France, Italy, Netherlands, Portugal and Switzerland), the delivery rates apply depending on the zone of your country, the type of delivery chosen, and the total value of your order as defined below.
It should be highlighted that for countries outside the European Union, VAT and customs charges may apply. These costs are the customer's responsibility and cannot be charged to Maison Jeanne.
Orders with delivery at home ("à domicile")
For all orders under 29€
The delivery fee is 3€ for all countries members of the EU except for Denmark, Germany, Finland, Ireland, Norway, and Sweden.
For those countries and the countries outside the EU, the delivery fee is 5,4€.
For all orders between 29€ and 60€
The delivery fee is 5€ for all countries members of the EU except for Denmark, Germany, Finland, Ireland, Norway, and Sweden.
For those countries and the countries outside the EU, the delivery fee is 8,4€.
For all orders between 60 and 95€
The delivery fee is 8€ for all countries members of the EU except for Denmark, Germany, Finland, Ireland, Norway, and Sweden.
For those countries and the countries outside the EU, the delivery fee is 12€.
For all orders over 95€
The delivery is free for all countries members of the EU except for Denmark, Germany, Finland, Ireland, Norway, and Sweden.
For those countries and the countries outside the EU, the delivery fee is 18€.
Orders Mail with delivery at home ("Courrier")
For the mail orders, which actually concern mainly the orders of the gift card Maison Jeanne, the delivery fee is 3€ for all countries.
Orders with Pick up
There is no delivery fee applying to the orders with pick up in-store, whether it is in Lille or Lisbonne. The same applies to all e-gift cards received by email.
Clause 2 - Exceeding the delivery period
Jabadao cannot be held responsible for the delay of routing being not of its fact or justified by a case of force majeure (as defined hereafter).
In case of exceeding the delivery period, the Customer may request the cancellation of the sale and obtain within a maximum period of 14 (fourteen) days of his/her request to this effect the reimbursement of sums paid on the occasion of the Order.
Notwithstanding the foregoing, Jabadao cannot be held responsible for the harmful consequences resulting from a delay in delivery, only the reimbursement of the Product by Jabadao being possible to the exclusion of any other form of compensation.
VI - Returns and refunds
Clause 1 - Right of withdrawal
The Customer has a right of withdrawal, which can be exercised by email to the following address: hello@maisonjeanne.com.
The right of withdrawal is exercised without penalty. In the case of use of this right by the Customer, the Product must be returned to Jabadao within 14 (fourteen) days (starting the day of receipt of the Products). The corresponding return costs are the responsibility of the Customer.
Beyond this period of 14 (fourteen) days, the sale is firm and final.
The Product must be returned in its original packaging, in its original condition, new, unworn and unwashed. To make a return, the customer must follow the procedure indicated on the Website by going to his/her Account, History and details of my Orders, Returns.
Clause 2 - Conditions of refund
The refund is subject to Jabadao being able to recover the Products initially delivered. Jabadao makes the refund using the same method of payment as the one used for the transaction.
The return of the Products is the responsibility of the Customer and is at his/her own risk according to the place of Delivery.
Force Majeure
The responsibility of either party can not be sought if the execution of the contract is delayed or prevented due to force majeure or fortuitous event, because of the other party or of a third or of external causes such as social conflicts, the intervention of the civil or military authorities, natural disasters, fires, water damage, interruption of the telecommunications network or the electric network.
VII - Applicable law - competent jurisdiction
The sale of the Products is subject to French law.
In case of dispute, the Customer and Jabadao may resort to a conventional mediation. In this respect, Jabadao informs the Customer of the existence of alternative dispute resolution methods such as in particular, mediation or arbitration.
The Customer can contact the dispute resolution platform put online by the European Commission at the following address: http://ec.europa.eu/consumers/odr/.
Any dispute relating to the interpretation of the GTSU, the execution or the rupture of a sale, the interpretation, the execution or the termination of the present ones is subject, in the absence of amicable agreement, to the legally relevant courts.
VIII - Confidentiality, personal data and cookies
In accordance with the provisions of the law n° 78-17 of 6th January 1978 relative to data processing, the files and the liberties, the site was the subject of a declaration with the CNIL (National Commission Informatique et Libertés) under the number 2039445.
All information in your account is used only in connection with your business relationship with www.maisonjeanne.com. This information is never shared with third parties or resold.
Your banking information is never in our possession. Transactions are fully processed by Paypal or the secure payment module of our partner Unicre.
The Website uses cookies (cookies) which the user is informed of when they arrive on the website that allows them to record information about the navigation of the computer on the website.
